1. Eligibility

You must be at least 18 years old and able to form a binding contract to use Foxyapp. By using the service, you confirm that you meet these requirements.

2. Accounts

Foxyapp accounts are provisioned with a license rather than open public registration. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use.

3. License grant

Subject to these terms and your payment, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Foxyapp on devices you control. The lifetime license is a one-time purchase that grants continued access to the licensed software, including updates we choose to provide. The license does not transfer ownership of the software or any intellectual property to you.

4. Usage credits

Certain features consume usage credits, measured in seconds of processing time. Credits are purchased separately from the license, are tied to your account, and are consumed as you use the relevant features. Credits have no cash value, are non-transferable, and, except where required by law, are non-refundable once purchased.

5. Payments

• License and credit purchases are made in cryptocurrency (USDT on the TRON/TRC-20 network).
• You are responsible for sending the correct amount on the correct network. Funds sent on the wrong network or to the wrong address may be permanently lost and cannot be recovered by us.
• Cryptocurrency transactions are irreversible. Once a payment is confirmed on the blockchain, it cannot be reversed by us.
• Prices are stated at the point of purchase and may change for future purchases.

6. Refunds

Because licenses unlock software immediately and credits are consumable digital goods, all sales are final and non-refundable except where a refund is required by applicable law. If you believe you were charged in error, contact us and we will review your case in good faith.

7. Acceptable use

Your use of Foxyapp is also governed by our Usage Policy, which is incorporated into these terms by reference. Violating the Usage Policy is a breach of these terms and may result in suspension or revocation of your license and account without refund.

8. Intellectual property

Foxyapp, including its software, models, branding, and website, is owned by us and protected by intellectual-property laws. You retain ownership of the media you create with the app, subject to your having the rights to the underlying source material. You are responsible for how that media is used.

9. Disclaimer of warranties

Foxyapp is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that results will meet your expectations.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of — or inability to use — Foxyapp. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising out of the content you create with Foxyapp or your violation of these terms or the rights of any third party.

12. Termination

We may suspend or terminate your access for breach of these terms or the Usage Policy, or to comply with the law. You may stop using Foxyapp at any time. Provisions that by their nature should survive termination will survive.

13. Governing law

These terms are governed by the laws of the jurisdiction in which Foxyapp operates, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.

14. Changes to these terms

We may update these terms from time to time. The “Last updated” date reflects the latest revision. Continued use of Foxyapp after changes take effect constitutes acceptance of the updated terms.
